Aspects and themes of franchising development


The rampant success of franchising all around the world is evident to everybody and the United States is considered as the most dynamic market for this system made in USA. Franchise has developed here into two different ways:

-        The so called "name brand product franchise" concerns the sale of products from franchisors by the payment of  a fee. This was the initial franchise formula working during the '50s.
-        The business format franchising has been representing the driving tool to start franchising in USA since 1950. Around the middle '50s the first McDonald's, Pizza Hut and Kentucky Fried Chicken restaurants were opened. By this formula the franchising bestower can identify himself into the franchisor producer and the steady and continuous relationship between franchisor and franchisee includes, besides products and services, registered trade mark, also the commercial formula of enterprise, strategies, marketing, quality control, internal communication and advertising.

The driving categories on the business format franchising are represented by the fast foods restaurants, food and beverage and restaurants sectors. Moreover the fast food sector is the leading sector both for number of employees and turnover. Concerning the product franchising, the most driving sectors are represented by gasoline pumps and car services, which counts the highest number of employees as well as the highest turnover.
Numerous laws have been promulgating in the United States to impact franchising and the franchisor behaviour before selling the franchise rights.
The federal law regulates the selling of franchise as well as of business opportunities. At the federal level, in October 1979 the US Federal Trade Commission issued a law termed "Trade regulation rule on franchise and business opportunities ventures" better known as "The Rule" to control all the fraudulent and deceitful negotiations.
Franchising in United States can trust in the International Franchise of Washington (IFA) founded in 1960 by a group of franchising entrepreneurs who seized the need of setting a body in the aim of giving services to franchises and to companies interested in the system, being a meeting point where members can exchange skills and experiences and intended to be the mouthpiece for the franchise universe. It is a nonprofit association representing more than 500 American companies.
